[2016-02-24] M씨의 난민 및 인도적 체류 신청

캄보디아 M씨와 대구출입국관리사무소에 왔습니다. 난민인정신청서를 제출하려고 기다리는 중입니다. 포항에서 대구출입국까지 M씨와 1월부터 벌써 세번째 방문입니다.

We are now in Daegu Immigration Office with Mr. M, a Cambodian, waiting for submitting an application for refugee status. This is the third visit to the Office since last month.

처음에는 난민사유가 아니라고 접수가 받아들여지지 않았고, 두번째는 생계비 신청을 함께 하려고 (생계비 신청도 대구출입국 방문신청이라) 연기했습니다.

At first, the Office did not receive Mr. M's application saying that his case does not involve any reasons related to refugee status. And at the next visit, we postponed in order to submit an application for living expenses with that for refugee status after we heard that the application for living expenses should also be submitted at Daegu Immigration Office by visiting.

대구출입국에서는 난민인정신청서를 접수하는 선생님이 한 명입니다. 한시간을 기다렸는데, 선생님이 지금부터인터뷰가 잡혀있어서 더 기다려야 한다고 합니다.

Only one officer in Daegu Immigration office is in charge of applications for refugee status. When we waited for an hour, the officer said due to the interview with an applicant for refugee status we may wait for her longer and she did not know when she would come back.

M씨는 난민자격이 아닌, 인도적 체류자격이 필요로 한 상황입니다. 작년에 신장이식수술을 받은 이후, 이식된 신장을 건강하게 유지시키기 위해 면역억제재 약을 평생 먹어야 하는데, 캄보디아에 돌아가게 되면 해당 약도 없고, 해당 약의 농도를 측정하는 시술도 불가능하기 때문입니다. 그렇게 되면 건강이 악화되어 생명을 잃을 수 있습니다.

Mr. M needs "humanitarian status." His case does not involve the five reasons related to refugee status. Mr. M had a transplantation surgery last year, and received his older brother's kidney. After the surgery he was told by a doctor that for the entire life he should take immunosuppressants. However, if he goes back to Cambodia, his transplanted kidney cannot be kept safe because in Cambodia there's no immunosuppressant nor possible medical examine to figure out the concentration of the drug. That means he will lose the kidney and eventually his life will be in danger.

미국에는 인도적 체류자격만을 따로 신청할 수 있습니다. "Humanitarian Parole" 이라고 하는데요. 난민법에서 말하는 인도적 체류자격보다 넓은 의미를 가집니다. 응급상황이 있는 경우, 그 응급상황이 진행되는 동안 일시적으로 체류를 허가하는 제도입니다. 한국에는 아직 이러한 자격이 없습니다. 인도적 체류자격도 난민인정신청을 한 이후에 불허가 되어야 고려대상이 됩니다.

In the US, a person who needs humanitarian status can apply for it separately. It is called"Humanitarian Parole." It seems to have broader scope than humanitarian status under the refugee law. When a person faces an emergent situation, he may apply for Humanitarian Parole and stay until the emergent situation finishes. Korea had no such system. Humanitarian status may be granted when am application for refugee status is rejected.
